Terms of Service
Version 2026-11-03. Effective November 3, 2026.
Please read sections 20 (limits on our liability), 21 (claims you cover) and 23 (Wyoming courts, no jury trial) with care.
1. Who we are
1.1 GetMyDMCA is a service of E.R MARKETING LLC, a Wyoming limited liability company with its address at 30 N Gould St, Sheridan, Wyoming 82801, United States. In these terms, "we", "us" and "our" mean E.R MARKETING LLC, operating the service as GetMyDMCA.
1.2 "You" means the person or business that holds the GetMyDMCA account. A "creator" is a person whose content you ask us to protect. A "takedown" is our work on one link: the notices and requests we send or file for it, and what follows them.
2. These terms and how you accept them
2.1 These terms are a contract between you and us. You accept them by ticking the box when you create your account. We record which version you accepted and when.
2.2 If you accept for a business, you confirm that you may bind it, and "you" includes that business.
2.3 Our Privacy Policy explains how we handle personal data. Please read it with these terms.
3. Who can use GetMyDMCA
3.1 You must be 18 or older and able to enter a contract. Every creator you add must also be 18 or older.
3.2 GetMyDMCA is for business use only: agencies that manage creators, and creators running their own business. It is not offered to consumers.
3.3 You may not use GetMyDMCA from a country or region under comprehensive US sanctions, or if you are on a US sanctions list.
4. Your account
4.1 Keep your password secret. We strongly recommend turning on two-step login. If you think someone else used your account, tell us at once at [email protected].
4.2 Anyone who signs in with your login acts for you, and you are responsible for what they do.
4.3 To help you or to look into a problem, our team can open your account for a limited time. We log each time we do.
5. What GetMyDMCA does
5.1 We search the web for pages that may show your creators' content, using the names you give us. We search only for creators we have verified (section 6).
5.2 You review what we find and approve the links you want us to act on. You can also paste links yourself.
5.3 For each link you approve or paste, we act as your creator's authorized agent (section 7). On the Standard plan, we ask Google to remove the link from its search results. On the Pro plan, we also notify the site itself: its host, its network provider (such as Cloudflare), its registrar or the platform.
5.4 Some notices are sent by our system. Others are filed by our team through online forms, so timing varies. We do not promise a turnaround time.
5.5 We track replies to our notices and may check whether a page is gone. An automated tool sorts the replies we receive and can update a takedown's status.
5.6 We may change or improve features over time. Our website describes the current features, but it is not part of these terms (section 23.5).
6. Creators and verification
6.1 You may add a creator only if you are that creator, or if the creator authorized you as section 8 describes.
6.2 We verify each creator before we send anything for them. We review the creator's public profile, and we may give you a code to place in its bio so we can confirm the profile is theirs. We may refuse to verify a creator.
6.3 Until a creator is verified, nothing is sent or filed for them. Links you approve or paste for them wait until we verify them. Links you paste for a creator we could not verify, or one you must confirm again, are refused.
6.4 If you change a creator's official profile links, the creator goes back to verification. Takedowns not yet sent for that creator wait until we verify the creator again.
6.5 We may also send a verified creator back to verification at any time, for example if we doubt your authority for that creator. This pauses work for that creator only, not for your other creators.
7. Your appointment of us as authorized agent
7.1 For each creator you add, you appoint E.R MARKETING LLC, operating the service as GetMyDMCA, as that creator's authorized agent. The creator is the rights holder our notices name. If you are an agency, you make this appointment for the creator, under the authority the creator gave you. As that agent, we may:
(a) send notices of claimed infringement under 17 U.S.C. section 512(c)(3), and similar notices under the laws of other countries, about the links you approve or paste;
(b) file removal requests through the forms of search engines, hosts, network providers, registrars and platforms;
(c) sign those notices and requests in our name as authorized agent, including the statements they make under penalty of perjury; and
(d) receive and answer replies about them.
7.2 We act only for a creator we verified (section 6), and only on links you approved or pasted (section 9).
7.3 The appointment for a creator lasts until you delete that creator or your account. After that, we send nothing more for that creator. We may still receive and answer replies about notices already sent.
7.4 If a creator withdraws their authority, delete that creator from your account at once. We then send nothing more for them, and we cancel their takedowns not yet sent. Notices already sent stay sent: we cannot recall them.
7.5 We act as an agent only for the notices and requests in this section. We are not your partner, your employee or your legal representative.
7.6 Our notices use fixed wording, and every change to it is a new version. They are never written by AI.
8. Your promises about every creator and every link
8.1 For every creator you add, you promise that:
(a) you are the creator, or the creator authorized you to send copyright takedowns for their content, and that authority lets you have them sent through GetMyDMCA;
(b) the creator owns the copyright in the content you ask us to remove, or holds an exclusive license to it. If someone else filmed or photographed it, the creator must hold a signed written transfer or a signed exclusive license from that person;
(c) everyone shown in that content was 18 or older when it was made;
(d) you may give us the creator's details, and you told the creator that you use GetMyDMCA and where to read our Privacy Policy; and
(e) the details you give us are accurate, and you keep them up to date.
8.2 For every link you approve or paste, you promise that it shows that creator's content. You also promise that its use there is not authorized by the creator, their agent or the law. Before you approve or paste a link, you consider whether it could be a lawful use, such as commentary, criticism or news reporting.
8.3 You confirm these promises when you tick a confirmation in GetMyDMCA. When you add a creator you represent, it reads: "I confirm this creator authorized me to send copyright takedowns for their content, including through GetMyDMCA, and that they own the copyright in the content I ask you to remove or hold an exclusive license to it." If you chose a creator account when you signed up and you add your own profile, it reads: "I confirm this is my profile, and that I own the copyright in the content I ask you to remove or hold an exclusive license to it." When you paste links, it reads: "I reviewed each link I am adding. Each one shows this creator's content, posted without their permission and not allowed by law, and I ask you to file a takedown for it." We record which confirmation you ticked and when. Approving a link in your dashboard confirms section 8.2 for that link.
8.4 We rely on these promises to sign notices under penalty of perjury. A person who knowingly and materially misrepresents that content is infringing can be liable for damages, including legal fees (17 U.S.C. section 512(f)). That can include you and us. Section 21 covers what you owe us if it happens.
8.5 Keep a record of each creator's authorization: a management agreement, an email from the creator, or our creator authorization form at getmydmca.com/creator-authorization. Keep it for at least 3 years after the last notice for that creator.
8.6 We may ask to see a creator's authorization at any time. If you do not show it within 7 days, remove that creator from your account. If you do not, we may pause that creator by sending it back to verification, or suspend your account. We keep our emails with you about it as our record; we do not add the document to your account.
8.7 If a creator tells us they did not authorize you, we pause that creator while we look into it, and we may suspend your account. We may also tell the creator which account added them. If we do, we tell you.
9. Approval: what we act on
9.1 We act only on links you approved or pasted. Pasting a link approves it.
9.2 We rely on your review. We do not check whether your creator owns the content behind each link.
9.3 We never send a notice against a creator's own official profile links. We may decline to act on any link.
9.4 You can cancel a takedown until it is sent or filed. A notice already sent cannot be recalled.
10. What a notice says and who sees it
10.1 A notice names the creator by stage name and lists the creator's official profile links as the place the original work is published. It lists the reported link and gives a reply address for that takedown. A notice sent by email also lists the page where we found the link, when we know it. Notices sent by email, or through the form of a host, network provider, registrar or platform, also give our postal address.
10.2 Our notices do not include your name, your email or the creator's legal name.
10.3 Recipients may forward or publish notices. Google may send copies of the requests it receives to the Lumen database, which publishes them. A host may forward a notice to the person who posted the content. You agree to this, for yourself and for your creators.
10.4 We do not give a recipient more than this about you without asking you first, unless the law, a court or an authority requires it.
10.5 A report link you share lets anyone who has the link see that creator's report, until you stop sharing it.
11. Results: no guarantee
11.1 Each site, host, platform and search engine decides for itself. It may refuse, ignore or delay a request, or restore content later. We do not control these decisions, and we do not guarantee that any link will be removed.
11.2 When your dashboard shows a link as off Google, Google told us it removed the link from its search results. The page itself may still be online.
11.3 A page shown as removed at the site means our check found the content gone, or the site confirmed to us that it removed it.
11.4 Content that was removed can appear again, at the same link or at another one.
12. Saved page copies
12.1 When we send or prepare a notice, we try to save a private copy of the page as our system received it. The copy may contain explicit material, or links to it.
12.2 You and our team can see these copies. You can download a copy from the takedown through a link that works for a few minutes.
12.3 You agree that we may make and keep these copies as evidence of what we reported. We keep them after you delete a creator or your account. We keep them until 3 years after the takedown reaches its final status, such as removed, already gone before we sent, canceled, or our checks ended without a removal. This does not apply to a copy that appears to show a person under 18. We report it (section 16.2) and keep or delete it only as the law requires. Our Privacy Policy explains this.
13. Plans, billing and renewal
13.1 Each creator on your account has its own plan, Standard or Pro. Prices are per creator, in US dollars, and are shown at checkout. We add taxes at checkout where the law requires them.
13.2 Payments are processed by Stripe and charged for E.R MARKETING LLC. You pay at the start of each billing period. You enter your card details on Stripe's pages, and they never reach our servers.
13.3 Your subscription renews automatically at the end of each period you chose (monthly, quarterly or yearly). It renews at your plan's current price, for each seat on it, until you cancel.
13.4 You can cancel at any time in Billing, or by writing to [email protected]. Canceling stops the next renewal. The service keeps running until the end of the period you paid for.
13.5 If you add a creator during a period and your plan has a free seat for it, nothing is charged: the creator takes that seat. If every seat on that plan is taken, we add one seat and charge a pro-rated amount for the rest of the period. All your seats renew on the same date.
13.6 If you remove a creator, its seat stays on your plan. You can keep the seat for another creator, or release it from your next bill. A released seat is charged until the end of the period already paid, which is not refunded, except under section 15.4. A creator we verified keeps its seat held for it until 30 days after you added it, and you can bring it back into that seat at no charge until then. A released seat stays held for its creator until your next bill.
13.7 If you change a creator's plan, we show you the amount before you confirm. The new plan applies to links approved after the change. After a move from Pro to Standard, takedowns already open at the site run to their end, and no new ones open there.
13.8 We may change our prices. We email you at least 30 days before a change, and the new price applies from your first renewal after that notice.
14. Late payment
14.1 If a payment fails, Stripe tries again. If your account is still unpaid 7 days after the payment was due, we pause scans and notices for your creators. They resume when you pay.
14.2 We do not delete anything because of non-payment.
15. Cancellation and refunds
15.1 You can cancel at any time (section 13.4).
15.2 Before the first notice. If no notice has been sent for your account yet, you can ask for a refund of your latest payment within 14 days of that payment. We refund it, and your plan ends at once.
15.3 After the first notice. Once a notice has been sent for your account, payments are not refunded, except as sections 15.4 and 17.3 say.
15.4 A creator we cannot verify. If we cannot verify a creator, its seat is free for another creator, and nothing is charged for adding one in its place. If you ask us while that seat is still empty, we refund what the seat was charged since that creator took it, and remove the seat from your plan at once. A creator we verified once is never refunded under this section.
15.5 Definitions. "Sent" means sent by email or filed through a form, by our system or by our team. "A creator we cannot verify" means a creator our review rejects. It also means a creator still not verified 30 days after you added it, if you ask for the refund. A creator we verified once is never refunded under section 15.4, even if it later goes back to verification. If you added a creator with a wrong name or link, correct it in the creator's settings: a correction is not a reason for a refund.
15.6 To ask for a refund, write to [email protected]. We refund to the payment method you used, through Stripe.
15.7 Nothing in this section limits rights the law gives you that a contract cannot exclude.
16. Acceptable use
16.1 You must not:
(a) add a creator without their authority, or give us false details;
(b) approve or paste a link you have not reviewed, or one that shows content the creator does not own or hold an exclusive license to;
(c) use GetMyDMCA against a lawful use of content, or against a competitor, a critic or lawful speech;
(d) submit any content or creator involving a person under 18;
(e) resell access to GetMyDMCA, or share your login with anyone outside your business. Protecting the creators you manage, and charging them for your own services, is not reselling;
(f) probe, scrape, overload or attack the service, or get around its limits or security; or
(g) use the service to find, harass or threaten anyone.
16.2 If we see signs that content involves a person under 18, we stop all work for that account and close it. We also report the content to the National Center for Missing & Exploited Children (NCMEC).
17. Suspension and closing
17.1 We may suspend or close your account if you break these terms, or if the law requires it. We may also do so if we believe a notice for you would be inaccurate. We may instead pause a single creator (section 6.5).
17.2 While your account is suspended, you cannot use the dashboard, and scans and notices for your creators pause. They resume if we lift the suspension. Write to [email protected] about a suspension.
17.3 If we close your account because you broke these terms, we refund nothing. If we decide to close it for another reason, and you did not ask us to, we refund the unused part of the period you paid for. If you ask us to close it, section 15 applies.
17.4 To close your account, cancel your plan, then write to [email protected] and ask us to delete the account.
17.5 When an account is deleted, we send nothing more for it, and we cancel its takedowns not yet sent. Notices already sent and their records stay, as our Privacy Policy explains.
18. Our service and your data
18.1 We own GetMyDMCA, its software, its design and its name. While you have an account, you may use the service for your business under these terms. You may not copy the service or transfer this right.
18.2 You keep your data. You let us use it to run the service, including putting creator names and links into notices, and to keep the records our Privacy Policy describes.
18.3 We may use anonymized, aggregated statistics, such as removal rates by site, to run and promote the service. We never name you or a creator without your permission.
18.4 If you send us ideas or feedback, we may use them freely.
19. No legal advice, and disclaimers
19.1 We are not a law firm. We do not give legal advice, and we do not represent you or your creators in any dispute or court case.
19.2 We are not affiliated with Google, OnlyFans, or the sites and platforms we contact.
19.3 To the extent the law allows, we provide the service "as is" and "as available", without warranties of any kind, including any implied warranty of merchantability, fitness for a particular purpose or non-infringement. We do not promise that we will find every leak, that any link will be removed, or that the service will always be available.
20. Limitation of liability
20.1 To the extent the law allows, we are not liable for indirect, incidental, special or consequential damages, or for lost profits, revenue or data.
20.2 To the extent the law allows, our total liability for all claims about the service is limited. The limit is the fees you paid us in the 12 months before the event that caused the claim.
20.3 This section limits our liability only. It does not limit what you owe under section 21, your payments, or your liability for breaking section 8 or section 16. Nothing in these terms limits a liability that the law does not allow to be limited.
21. Indemnity
21.1 You will defend E.R MARKETING LLC, its owners and its staff against any claim brought by someone else that arises from:
(a) a creator you added, your promises in section 8, or a confirmation you ticked;
(b) a link you approved or pasted;
(c) a claim that a notice we sent on your instruction misrepresented infringement (17 U.S.C. section 512(f)); or
(d) your breach of these terms.
You will also pay the losses and costs the claim causes them, including reasonable legal fees.
21.2 This section does not cover a claim to the extent it results from our own breach of these terms, our negligence or our misconduct. An example is a notice we sent for a link you did not approve or paste. We will tell you about a claim promptly. We may choose our own lawyers and control the defense, and you will cooperate. Section 20 does not limit this section.
22. Changes to these terms
22.1 We may update these terms. We post each new version on this page with its version and date.
22.2 If a change reduces your rights, we also email you at least 14 days before it applies, and you may cancel before then. A price change gets 30 days' notice (section 13.8).
22.3 If you keep using the service after a change applies, the new version applies to you.
22.4 A change does not apply to a dispute that arose before the change applies.
23. Law, notices and general terms
23.1 These terms are governed by the laws of the State of Wyoming, United States, without regard to its conflict-of-laws rules. Any dispute about these terms or the service will be decided only by the state or federal courts located in Wyoming. You and we consent to their jurisdiction.
23.2 JURY TRIAL WAIVER. TO THE EXTENT THE LAW ALLOWS, YOU AND WE EACH KNOWINGLY AND VOLUNTARILY WAIVE ANY RIGHT TO A JURY TRIAL IN ANY DISPUTE ABOUT THESE TERMS OR THE SERVICE.
23.3 You must bring any claim against us within one year after the event that caused it.
23.4 We send notices to you by email, to your account address. Send notices to us at [email protected], and by post to E.R MARKETING LLC, 30 N Gould St, Sheridan, Wyoming 82801, United States.
23.5 These terms are the whole agreement between you and us about the service, and they override anything on our website. A separate written agreement signed by you and us overrides these terms where it says so.
23.6 If a court finds part of these terms invalid, the rest still applies. If we do not enforce a term, we do not waive it. You may not transfer these terms without our written consent. We may transfer them to an affiliate or to a buyer of the business. Neither of us is liable for a delay or failure, other than a payment, caused by events beyond its reasonable control. The English text governs.
23.7 These sections continue after your account ends: 7 (as needed to receive and answer replies about notices already sent), 8, 10, 12, 15 (for past payments), 18.2, 18.3, and 19 to 23.
24. Contact
24.1 Questions about these terms: [email protected]. By post: E.R MARKETING LLC, 30 N Gould St, Sheridan, Wyoming 82801, United States.
